Gun law in Alcenia is found at the federal, state, and local level. Article VI, Section 3 of the Alcenian Constitution protects the right to keep and bear arms:
"Congress shall make no law infringing on the right of the people to keep and bear arms, nor shall any state make any law infringing on the right to keep and bear arms."
The central legislation governing firearms at the federal level is the National Crime and Safety Act of 1995 (NCSA), which largely replaced the Gun Control Act of 1955. The NCSA was controversial at its passage and remains a subject of heated debate today. It created the National Firearm Eligibility System (NFES) which all federally licensed firearms dealers are required to use as well as increasing the penalties of federal crimes that involve the use of a firearm. Some aspects of the law, such as a provision allowing information on background checks to be accessed by a Freedom of Information Request, have not survived constitutional challenges. The law also banned handguns within the City and District of Sunalie, which also found to be unconstitutional. The Controlled Materials Enforcement Agency is the primary federal gun law enforcement agency.
Federal law governs primarily who is and is not allowed to possess a firearm in Alcenia. Under current law, any person who:
is a convicted felon
is not a citizen of Alcenia or a lawful permanent resident of Alcenia
has been declared to be mentally incompetent
has been dishonorably discharged from the Alcenian Armed Forces
has a restraining or protection order against them
has been convicted of possession, sale, or use of a controlled substance as defined in the Clean Streets Act of 1978
has been convicted of purchasing for, selling to, gifting to, or otherwise granting access or attempting to grant access to a firearm to a prohibited person
is ineligible to possess or purchase a firearm in Alcenia.
